GENERAL CONDITIONS

BIOPLANET OÜ (hereinafter referred to as Bioplanet), with the registration number 11920653, located at Merirahu Street 43, Haabersti District, Tallinn, Harju County 13516, is an online store that sells vitamins and dietary supplements.

These terms of use regulate the procedure of purchase and sale transactions between Bioplanet and the Customer through bioplanet.ee. In addition to what is stipulated in the terms of use, both Bioplanet and the Customer (hereinafter collectively referred to as the Parties) shall be guided by the laws and other legislative acts in force in the Republic of Estonia and the rights and obligations arising therefrom in sales transactions in Estonia. These terms of use regulate the procedure of purchase and sale transactions between Bioplanet and the Customer through bioplanet.ee. In addition to what is stipulated in the terms of use, both Bioplanet and the Customer (hereinafter collectively referred to as the Parties) shall be guided by the laws and other legislative acts in force in the Republic of Estonia and the rights and obligations arising therefrom in sales transactions in Estonia.

1. General provisions

1.1. In regulating their mutual relations, the Parties shall be guided by the laws and other legislative acts of the Republic of Estonia and by the provisions of the User Agreement.
1.2. Bioplanet has the right to make changes to the services offered in the online store at any time.
1.3. Bioplanet has the right to unilaterally amend the terms of the user agreement without being obliged to notify the Customer in writing by email.

2. Products and making a purchase

2.1. Bioplanet sells and the Customer of the online store buys the Products offered in the online store.

2.2. The Parties consider the order submitted by the Customer to be the Customer’s wish to conclude a sales contract with Bioplanet for the goods specified in the order. The sales contract enters into force when the amount to be paid by the Customer is received in Bioplanet’s SEB, LHV, or Swedbank account.
2.3. Most of the displayed products are immediately available in stock.
2.4. If any product is out of stock and the order cannot be fulfilled, an online store employee will contact the Customer as soon as possible, usually on the same business day but no later than within 3 (three) business days. In this case, a new possible delivery time or replacement of the product with an equivalent product of the same price and quality will be offered. If the Customer does not agree to the new terms, they may refuse the order, and any money already paid will be refunded.

2.5. The cost of the shipping service is added to the price of the product and depends on the Customer’s preference for the delivery of the products and the choice made when placing the order. All applicable shipping service prices are visible to the Customer in the cart in the subsection for the shipping method before confirming the order.
2.6. Bioplanet does its best to ensure that there is an illustrative and as true-to-life as possible product photo for all Products. If the product significantly differs from the illustrative photo, relevant additional information is provided in the respective subsection of the Product description.
2.7. Bioplanet does its best to provide a as accurate product description and comprehensive additional information on the product page for all Products. Bioplanet updates and supplements the additional information regularly and responds to Customer inquiries and additional questions, attempting to provide relevant recommendations based on the specific needs of each Customer.
2.8. The Customer who selects the desired products undertakes to enter the data required to fulfill the order (last name, first name, contact phone, email address, delivery address, postal code, payment method).
2.9. The Customer undertakes to provide accurate data necessary for the fulfillment of the order. The store manager is not responsible for the non-fulfillment of the order or any consequences resulting from incorrect data provided by the Customer.

2.10. Bioplanet reserves the right to withdraw from the purchase and sale transaction if the price displayed for the product in the online store differs significantly from reality due to an obvious human error or a systemic technical error. For minor errors and differences, the product will be sold at the price displayed in the online store.

3. Prices

3.1. The basic prices of all products in the online store are in euros.
3.2. Bioplanet has the right to supplement and change the product characteristics and/or price information at any time. All changes and additions enter into force when published on the bioplanet.ee website. Bioplanet has no additional obligation to inform Customers separately in writing of all changes and additions.

3.3. If the store manager has changed the prices in the online store after the Customer has placed an order and paid for it, the products will be delivered to the Customer at the prices in force at the time of placing the order. The Customer is not entitled to demand compensation for a price difference.

4. Delivery time and delivery conditions

4.1. Orders submitted in the online store are reviewed on the same business day, and orders for which payment is received on business days no later than 2 p.m. are usually sent on the same business day.
4.2. The guaranteed delivery time of the products is 5 business days unless otherwise stated in the product description. In general, the delivery time of the products is less than 3 business days. If Bioplanet cannot deliver a product within 5 business days, the Customer will be informed immediately. If necessary, the Customer has the option to cancel the order, and Bioplanet will refund the money. Due to a state of emergency, courier companies may be overloaded, and the delivery time may be longer.

4.3. The products are delivered to the delivery address provided in the order at the agreed time according to the availability of the goods. The products are handed over only to the buyer. The products are handed over to a third party only with the buyer’s consent.

4.4. The Customer has the right to choose between the following methods of receiving the products:

2. Omniva Parcel Locker
3. Omniva Courier Service
4. SmartPOST Parcel Locker
5. DPD Courier

5. Withdrawal from the contract before performance by Bioplanet

5.1. If the Customer wishes to withdraw from the contract after submitting an order and before the service provider’s performance of the contract, they shall promptly notify Bioplanet in writing. Written notice must be sent to the email address abi@bioplanet.ee or by calling +372 510 2737. The email must include the order number from which the Customer wishes to withdraw and the Customer’s contact details (first name, last name, order submission date, contact phone).
5.2. If the notice of withdrawal reaches the provider after Bioplanet has performed the contract, the withdrawal from the contract will occur in accordance with the “Right of Withdrawal” section of the User Agreement.
5.3. Bioplanet will refund the amount paid by the Customer within 30 days from the receipt of the withdrawal request.
5.4. The refund will be transferred to the same bank account from which the payment was received by Bioplanet OÜ.

6. Right of withdrawal

6.1. Purchases from the online store have a 14-day right of withdrawal.
6.2. There is no right of withdrawal for products that have been customized according to the customer’s wishes (added images, text, etc.).

6.3 The product must be returned in its original packaging, along with additional materials and the shipping package in which it was sent to the Customer. The original packaging must always be opened carefully and without damaging the packaging. 6.4. The product to be returned must be without defects, complete, in its original packaging, and free of any signs of use.
6.5. The refund will be made to the Customer within 30 days from the return of the product.

6.6. In the case of an exchange, a new product will be sent to the Customer as soon as it is available in Bioplanet’s warehouse and the product eligible for exchange is received.

6.7. The refund will be transferred to the same bank account from which the payment was received by Bioplanet OÜ.
6.8. The customer covers the transport costs associated with the product return.

6.9. Bioplanet will cover the transport costs associated with the return only in cases where the product has been damaged in a way that did not result from opening the packaging, or if the wrong product was sent to the Customer.
6.10. If it becomes apparent after the return that the return does not comply with the conditions stated in the User Agreement, the money will not be refunded.

7. Personal data and its use

7.1. Bioplanet processes the Customer’s personal data in accordance with the requirements of data protection legislation. The Customer provides clear and informed consent to Bioplanet for the processing of their personal data.
7.2. The personal data provided by the Customer when placing an order is entered into the customer register and is used to provide sales services and offer products to the Customer.
7.3. The source of personal data is the establishment of a customer relationship when registering an order in the online store.
7.4. The composition of the personal data to be registered includes the information about the Customer’s order (last name, first name, street, house, apartment number, locality or city, postal code, phone number, year of birth, gender, delivery method, payment method used, agreement with the online store’s User Agreement for sending sales offers by email, and any free-text comments entered).
7.5. Personal data necessary for the delivery of the product to the Customer may be transferred to companies providing courier services.
7.6. Bioplanet does not transfer, sell, or disclose Customer data to parties not mentioned above without the Customer’s prior consent or only in cases provided for by law.
7.7. The Customer has the right to access, modify, or delete personal data concerning them.
7.8. The Customer provides Bioplanet with consent to send an order confirmation to the email address provided upon order placement.
7.9. If the Customer has expressed a desire to receive newsletters from Bioplanet in the future, Bioplanet will use the Customer’s data to send newsletters. The Customer has the right to unsubscribe from the newsletter at any time by clicking on the link in the newsletter.

8. Terms of use

8.1. Familiarity with the terms specified in the User Agreement is mandatory for the Customer.
8.2. By placing a checkmark in the relevant box when submitting an order, indicating “I agree to the store’s terms of use and will fulfill them without reservation,” the Customer agrees that they have read and understood the terms specified in the User Agreement and agrees to abide by the terms specified in the User Agreement.

9. Procedure for handling complaints

9.1. In the case of defective products, the consumer has the right to file a complaint with the seller within two years from the date of handing over the product. The complaint must be filed immediately, but not later than two months from the discovery of the defect. To make it easier to resolve future issues, the consumer should retain purchase documents (invoice, contract, etc.) as evidence of purchasing the product from the online store managed by Bioplanet OÜ. The seller may leave the problem unresolved without the consumer providing evidence of the sale.
9.2. Complaints may be filed for manufacturing and material defects.
9.3. The period for filing complaints begins from the date of purchase.
9.4. Bioplanet OÜ or the manufacturer of the product carries out an expertise to determine the existence and cause of the defect.
9.5. An independent expertise – an additional paid expertise conducted by an independent expert at the request of the consumer if the consumer is not satisfied with the results of the expertise conducted by Bioplanet OÜ.
9.6. A complaint will not be processed if Bioplanet OÜ proves that defects in the product are due to the fault of the consumer.
9.7. If the product has been discontinued after the complaint, with the consent of the consumer, Bioplanet OÜ reserves the right to replace the product with an equivalent.
